Server Services Agreement

1. Acceptance of Terms
By purchasing or using any voice server hosting service provided by LightSpeed Gaming LLC ("Provider"), you ("Customer") agree to be bound by the terms and conditions set forth in this Server Services Agreement ("Agreement"). If you do not agree to these terms, do not use our services.
2. Service Description
Provider offers managed voice server hosting for Ventrilo, TeamSpeak, and Mumble platforms. Services include server provisioning, management via the customer control panel at cp.light-speed.com, and technical support.
3. Account Responsibilities
Customer is responsible for maintaining the confidentiality of their account credentials and for all activity that occurs under their account. Customer must notify Provider immediately of any unauthorized use of their account.
4. Acceptable Use
Customer agrees not to use the services to:
- Violate any applicable local, state, national, or international law or regulation.
- Transmit any material that is unlawful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
- Interfere with or disrupt the services or servers or networks connected to the services.
- Attempt to gain unauthorized access to other accounts, computer systems, or networks.
5. Payment Terms
All services are billed on a monthly basis. Payment is due at the time of order and upon each renewal. Failure to pay may result in suspension or termination of services. All prices are in United States Dollars (USD).
6. Refund Policy
Refund requests may be submitted within 7 days of initial purchase. Refunds are issued at the sole discretion of Provider. Renewal payments are non-refundable.
7. Service Level
Provider strives to maintain 99.7% uptime for all hosted voice servers. Scheduled maintenance windows will be communicated in advance when possible. Provider is not liable for downtime caused by circumstances beyond its reasonable control.
8. Termination
Either party may terminate this Agreement at any time. Provider reserves the right to suspend or terminate services immediately if Customer violates this Agreement. Upon termination, Customer's access to the services and any associated data may be permanently deleted.
9. Limitation of Liability
To the maximum extent permitted by law, Provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the use of the services. Provider's total liability shall not exceed the amount paid by Customer in the twelve (12) months preceding the event giving rise to the claim.
10. Modifications
Provider reserves the right to modify this Agreement at any time. Continued use of the services after any changes constitutes acceptance of the modified terms.
